Welcome to America's legal system where money alone will determine success. In most other countries the losing party in a lawsuit will be required to cover all cost, so in obviously groundless cases there'd be nothing to gain. But welcome to America! Just drag it out long enough so that your opponent will have to fold for purely financial reasons, because even if they win, they still lose.

That's something a lot of people here have been pushing to get changed for years. With the rise of patent/copyright trolls in this modern era, entire businesses are springing up around the concept of filing frivolous lawsuits with the expectation of the defendant settling rather than eating the cost of going to court. We know it's completely screwed up.
I'm going to go out on a limb here and place the blame for this situation on Mr. Pitchford. Gearbox as a company I'm sure isn't filled with self-absorbed asshats, just working for one.

It's shit like this from all types of gaming companies, even Nintendo, Sega, Namco and whatever you can think of are why I believe copyright bullshit isn't doing anything to prevent piracy: It's promoting it. You'll be surprised how many ROM and torrent sites there are that people are willing to simply download these games for free, I'm not saying it's right but it's not hard to see why. ((And no, I am not linking any for obvious reasons.)) This is no exception: People are probably going to be pirating Duke3D if Gearbox wins.
