Well, I think the dying space marine kinda gives away the fact that it's not an MS error... ity's not that difficult to destinguish between the two. Too many people act without thinking first...
I like the seccond one, it looks more professional and user friendly. If you ask me, people that are being anal about it because it looks like MS' are just being... urm, anal for the sake of being... urm, anal

Yes, the dying marine gives it away but you can't expect the average user to recognize that. Even I thought it was a joke when I first saw it ('Hey, I improved ZDoom. Now it will report all crashes to Micro$oft') The idea itself is ok but you have to be extremely careful so that the end user doesn't misunderstand what is happening.
