I'm not convinced there would even be a conflict if not for their crap mobile game which I doubt most people have even expected to exist, much less heard of. Sure, everyone's got an app these days, but come on...

And I'm sorry to say, for me the answer is "yes".

When you get down to brass tacks, this unfortunately is true.

The legal system does not care whether you had intended to make a reference to the trademark or not. It just cares if you knew. And you can count on the fact that the band's lawyers have probably already visited the linked thread and found that information and has put it in their evidence folder.

Ion Fury is a better name anyway. :)

I hope this means the lawsuit is settled, too, but obviously this is no true indication of that.

The generated social media buzz from this entire episode was also quite helpful. :)

Anyway, can't wait to play the full game! Finished the Early Access levels plenty of times already.

This looks awesome, like really awesome.

I bet actually does means the lawsuit is settled. The only thing Iron Maiden Holdings had against them in the lawsuit was the name. Everything else was bullshit straw grabbing. Trying to sue over using the name Harrison? Give me a break.

Been saying pretty much that since the story broke. The cynic in me still wonders how deliberate it might have been. In this case, I think unlikely but you never know. Image

Anyway, I hope that this legal fuss is all over now. The game looks like it should be good and I wish them all the best with it.

Of course, there are games called "Fury", "Fatal Fury", "Streets of Fury", "Fury Unleashed", "The Fury"...

and there are also the metal ands "Master Fury", "Fury" and probably others too. ;)

It probably wasn't. The lawyers would have known those claims were weak. It was more likely just part of a "shock and awe" approach to hit them hard with every conceivable issue (real or not) to make the initial claim much more aggressive (and also maybe to see what might stick).

And of course each of the pleaded allegations could be dragged all the way into court, taking up more time and money even if they were without merit, thus making it much harder for the other side to fight the thing on its merits.

I think there could be costs consequences of that, but then you'd still have to litigate about the costs.

Sure they could have dragged it out, but on the downside, if the court had found that the allegations were slanderous it could have easily backfired. But as ammunition for an out-of-court settlement it was valuable. What they really wanted is to have the name discontinued, nothing more, nothing less. I'd say the matter is settled by now. If they drag this to court now they appear as bullies and that'd come with the risk of genuinely harming their image which would cost more than the damages they sued for.
