Permission from the Developer's and Publisher's ?

Permission from the Developer's and Publisher's ?

This might seem strange to you but if I make a mod that used music or sounds of a game that I owned do I have to ask the permission to the developer's or publisher's to destribute the mod with the aforementioned things on modding communities ?

This is pretty tricky. Normally, you do, but by the nature of a modding community we usually get a pass even if we don't, mostly because there's no financial incentive behind it, but even that is with a few notable exceptions.

If we get a C&D though, we have to comply - full stop.

Most developers and publishers tend to turn a blind eye to dumb little non-profit fan projects like ours, because stamping them into dust would generally do more harm than good PR-wise. Sometimes, though, the hammer comes down - usually to projects aspiring to be direct remakes or recreations of pre-existing games - and that's that.
